BOOKING TERMS & CONDITIONS
These terms and conditions set out the basis on which STAY Hostel will provide accommodation and other products and services at its hostel to its customers and guests. These terms and conditions govern all bookings made through our booking services, whether through our website, mobile website, mobile application or a booking engine integrated into third party websites.
1. Definitions
1.1. Unless the context otherwise requires, the following expressions have the following meanings:
1.1.1. “Arrival Date” means the date on which the customer’s stay at the hostel is due to commence, as per the booking details.
1.1.2. “Booking” means the reservation by the customer of accommodation and any other products and services detailed in the booking which is accepted by the hostel.
1.1.3. “Booking details” means the details of the booking including the number of guests, the number of rooms required, the duration of the guests’ stay at the hostel and any other products and/or services to be included in the booking.
1.1.4. “Charges” means the charges payable by the customer in connection with the booking.
1.1.5. “Contract” means the contract between the Customer and Stay Hostel in relation to the booking
1.1.6. “Customer” means person who makes the Booking,
1.1.7. “Hostel” means the hostel owned or operated by STAY Private Company, VAT No.: EL800713087, named STAY Hostel and located at 61, Ionos Dragoumi Str., Thessaloniki, Greece.
1.1.8. “Guests” means the customer and any third parties they invite to the hostel in connection with the booking.
1.1.9. “Low season” shall be defined as the time period between (……………..)
1.1.10. “High season” shall be defined as the time period between (………………)
1.1.11. “Super high/peak season” as the time period between (………..)
2. Bookings
2.1. Customers can request bookings via the hostel’s website or by contacting our staff at the hostel. Booking requests may also be made through mobile applications or a booking engine integrated into third party websites.
2.2. When requesting bookings, customers will be required to provide identification information including, but not limited to, their name, address, contact telephone number and email address.
2.3. No request for a booking should be deemed to be accepted unless and until the hostel confirms its acceptance and provides a booking reference, at which point the contract will come into existence.
2.4. Subject to clause 4, the hostel will endeavour to accommodate any reasonable request from the customer to change the booking details. However, any request to change the dates or length of stay or add products and/or services will be subject to availability and the customer paying for such increased length of stay and/or additional products and/or services at the hostel’s standard rates from time to time.
2.5. By making a booking, the customer hereby agrees to comply with these terms and conditions as well as with the hostel’s rules, which are annexed thereto and form an integral part thereof, and shall also be visibly posted in the reception area of the hostel.
2.6. The hostel does not accept bookings made by persons under the age of 15. Persons below the age of 18 cannot stay in any shared rooms, however they can stay in private rooms when accompanied by a person over 18 years old. Any person between 15 and 18 years of age wishing to stay in a private room, will need written consent from their parent or guardian. Failure to adhere to this rule will result in automatic cancellation with no refund given.
3. Fees and payment
3.1. The charges will be as quoted by the hostel to the customer upon the customer’s request for a booking.
3.2. Unless otherwise agreed by the hostel, the charges only cover the provision of accommodation at the hostel and the customer may incur additional charges including, but not limited to, charges for meals, room service and wireless internet access (“additional charges”).
3.3. Customers will be informed of the amount of the additional charges before they are incurred.
3.4. Bookings will be subject to the customer (a) making payment of the charges in full in advance or, at the hostel’s option, paying a booking fee and/or deposit or paying in full on arrival; and (b) providing valid debit or credit card details via which payment of the charges or the balance of the charges (as the case may be) and any additional charges can be taken at check in at the hostel or at the time of booking.
3.5. If not prepaid in full at time of booking the balance of the charges must be paid by the customer immediately on checking in [alternative: checking out] at the Hostel. Any additional charges must be paid either as they are incurred or, at Hostel’s option, upon the customer checking out at the Hostel.
3.6. The following payment methods are accepted by the Hostel
3.6.1. Credit and Debit Cards: American Express, Diners Club, Visa and Mastercard (online and at check-in)
3.6.2. Cash, if the customer is paying in person at the hostel.
3.7. Unless otherwise agreed, the charges do not include any food or drink.
4. Cancellations
4.1. The customer may cancel the booking without charge if written notice is given to the hostel at least 48 hours prior to the scheduled check-in time on the arrival date (see clause 5.2), in which case the hostel will refund to the customer all sums paid by him/her in advance, except for the booking or cancellation fee or charge, as the latter may apply per the clauses below.
4.2. For cancellation notices served no later than 7 calendar days before the date of arrival during the low season, 14 days before same date in the high season, and 21 days before said date in the super high/peak season, no cancellation fee shall be applicable.
4.3. Where the customer fails to give sufficient and timely notice of cancellation as per clause 4.2, the booking will be deemed cancelled and the customer must pay a cancellation fee equivalent to the charges applicable to the first’ night’s stay at the hostel. In the event that notice is given later than the deadline set forth in clause 4.1, or the customer fails to arrive (no show), the full amount of the reservation shall be payable to the hostel.
4.4. Where the customer has been offered a discounted rate on condition that the booking may not be cancelled then, provided the customer has been informed of such condition, the booking may not be cancelled and the charges applicable to that booking are payable in full.
4.5. In case of departure prior to the arranged date, there will be a cancellation fee for 100% of the remaining stay.
4.6. The hostel may at any time cancel a booking if it becomes unavailable due to circumstances outside its control, in which case it will pay the customer a full refund of any charges and any booking fee paid.
4.7. The hostel may at any time cancel the booking if the payment details provided by the customer in accordance with clause 3.4 are invalid and the customer fails to provide alternative valid details.
5. Check-in and check-out
5.1. Valid photo identification in the form of an Identity Card, Driver License or Passport is required at check-in.
5.2. Check-in time at the hostel is at 13:00 hrs. on the date of arrival. Check-in prior to 13:00 hrs. may be available subject to prior arrangement and to the full range of services and facilities not being available until the standard check in time.
5.3. Check-out time is 11:00 hrs. on the date of departure. Later check-out times may be possible by prior arrangement with an additional charge and subject to availability. In the absence of such prior arrangement, failure to check-out by 11:00 hrs. may result in the customer being charged for an additional night’s accommodation at the standard applicable rate.
6. Disabled Guests
6.1. The hostel complies with all laws regulating the treatment of, and provision for, disabled guests.
6.2. Customers with any special requirements pertaining to a disability should inform the management team at the hostel prior to the arrival date.
7. Hostel’s liability
7.1. Nothing in these conditions purports to limit or exclude the Hostel’s liability for:
7.1.1. death or personal injury caused by the negligence of the hostel’s owner(s) or management, its employees, subcontractors or agents;
7.1.2. fraud or fraudulent misrepresentation;
7.1.3. any other matter for which it would be illegal for the Hostel to limit or exclude its liability.
7.1.4. The customer agrees that the hostel is only supplying its facilities, products and services to the customer for private use and has no liability to the customer for any loss of profit, loss of business, business interruption or loss of business opportunity.
8. Privacy policy
8.1. The hostel complies with its obligations under the Greek Data Protection legislation. It shall process personal data in relation to customers and guests solely for the purpose of performing its obligations and exercising its rights in connection with the contract. It will not provide any such personal data to any third parties without the consent of the data subject or unless required by law or official order.
8.2. The customer hereby consents to the collection of his/her personal data such as name, surname, email address, customer number, address, contact information, payment details and IP number.
8.3. The personal data may be used for marketing purposes and as a basis for statistics and for the hostel’s product development.
8.4. The customer agrees to receive marketing information via mail, telephone, or e-mail and text messages, and other digital channels. The customer may opt out of such communications either during the booking process or at any point in the future.
9. General terms
9.1. The customer’s rights as a consumer under consumer protection legislation from time to time in force shall not be affected by these conditions.
9.2. The hostel may transfer its rights and obligations under the contract to another entity but will always inform the customer if this happens and this will not affect the customer’s rights under the contract.
9.3. The hostel will not be liable to the customer for any failure to perform or delaying in performing its obligations where such failure or delay is due to an event outside the hostel’s control (including without limitation, extreme adverse weather, industrial action or natural disaster, and any other case of force majeure). If such an event prevents the Hostel from fulfilling the booking, either party may cancel the contract.
9.4. The hostel reserves the right to change these conditions without notice. However, the version of these conditions in force at the time of the booking will continue to apply to the contract. Customers are advised to check the hostel’s website for the latest version of these conditions before making a booking.
9.5. No failure by the hostel to enforce these conditions shall constitute a waiver of the right to subsequently enforce that provision or any other provision of these conditions. Such failure shall not be deemed to be a waiver of any preceding or subsequent breach and shall not constitute a continuing waiver.
9.6. If any provision of these conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these conditions and the remainder of the provision in question shall not be affected.
9.7. These contracts (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the laws of Greece and the courts of Thessaloniki, Greece shall have exclusive jurisdiction to deal with any disputes arising out of or relating to these contracts or the use of this website in general.
HOSTEL RULES
Accommodation terms and house rules
Guests may check-in from 13:00 onwards on the date of arrival. Check-out is at 11:00 on the date of departure. If earlier check-in or later check-out is desired, hostel staff should be contacted in advance to determine whether it is possible and at what cost. Later check-out without due notice may result in the customer being charged for an extra night’s accommodation.
In case a free room is not filled to capacity by the persons on the same booking, they shall be accommodated in one or more rooms with occupants of the same sex. If this is not possible, the individuals shall be so notified prior to the confirmation of their booking. Generally, when booking beds in a shared room, effort is made to assign the same room to all persons on the same booking.
Guests are required to conduct themselves in a reasonable and responsible manner and must not act in any way which may disturb other guests. Failure to adhere to this requirement may result in guests being asked to leave the hostel in which event all charges and additional charges shall become immediately payable by the customer.
Guests are requested to observe quiet hours between 15:00-17:30 and 23:00-07:00 in summer (1 April – 30 September), and 16:30-17:30 and 22:00-07:30 in the winter (1 October – 31 March).
Smoking is not permitted inside the hostel, except for the designated smoking areas.
No animals are allowed in the hostel, with the exception of guide dogs.
Public health issues
The hostel may request the immediate departure of any customer or guest suffering from an infectious disease.
Safety and security policy
Storage lockers and room
Hostel guests may store their personal belongings in the lockers provided for that purpose in the reception area, in their rooms or in the luggage storage area. It is recommended that personal documents and valuables are only stored, if so desired, in the lockers adjacent to the reception area. Although all lockers are secure, the Hostel cannot and does not accept responsibility for theft of items stored therein.
Forbidden items
Firearms (including airguns, starting pistols or imitations), ammunition, knives, explosives or inflammable substances such as petrol may not, under any circumstances, be stored anywhere in the rooms or Hostel premises.
Fire safety
Guests shall familiarise themselves with escape routes and assembly points in case of fires.
Fire escapes shall be left unobstructed and personal belongings shall not be placed in corridors or on stairwells.
The use of candles or other naked flames is expressly forbidden. Always keep flammable materials (clothes, books, papers etc.) away from heat sources such as kettles, hair tongs/straighteners, radiators, light bulbs etc.
Any undue interference with fire safety equipment, such as portable or fixed-place fire extinguishers, sprinklers, smoke detectors, fire doors etc. is strictly forbidden. Improper use or removal of keys to emergency exits, and tampering with, or improper use of, fire escapes and fire exits is also prohibited.
In the event of a fire alarm, guests shall follow the nearest escape route. Each alarm must be treated as a potential fire, even if it turns out to be a false alarm.
Payment in full will be demanded for all damage caused by unnecessary use of the fire safety equipment.
Reception hours
Our reception is available around the clock. Our staff is available for any questions or issues. Information brochures and maps are also available at the reception desk, as is a first-aid kid.
Kitchen and mess hall
The kitchen and mess hall are open around the clock, and are fully equipped. Guests are requested to keep those spaces clean and tidy, and to report any equipment malfunctions immediately.
Cleaning and maintenance in general
The communal areas of the Hostel as well as the rooms are cleaned on a daily basis. Guest shall be liable for the Hostel’s reasonable cost of repairing, cleaning or replacing any property of the Hostel which is damaged, soiled or lost by a guest.
Other services
Wi-Fi, as well as a public access computer, is available in the communal areas of the Hostel.
Laundry and ironing room is available for the use of the guests.
Amendments
The hostel’s rules pertaining to the conduct of its customers and guests and the availability of facilities and amenities may be amended at any time and with immediate effect, in accordance with Greek law. However, only the general booking terms and conditions in force at the time of the booking shall be applicable.
